Effective May 1, 2014, it is the standing order of the Gwinnett County Magistrate Court that a plaintiff filing a garnishment action must file proof of an active judgment against the defendant along with the garnishment affidavit. Proof of judgment shall include active writs of fieri facias.

Recently there has been a trend by some members of the Bar to use more than one address for legal counsel on cases filed in the Gwinnett Judicial Circuit.

All deputy clerks in the Clerk’s office are trained to check the attorney’s address on each and every case or pleading filed. When a new address appears that is different than our database address the attorney’s address is changed.

Changing the address in the database will in turn change all cases pending for that attorney, as the case management system attorneys’ database is not case specific. Unfortunately by using a different address on a succession of cases the attorney will not receive notices in other pending cases. In other words, the new address will be the address of record for all cases.

The public should be aware of a scam that is occurring across the nation.

You may receive a telephone call or text message notifying you that you have missed jury duty and that you should immediately call the telephone number provided. The text further directs the recipient to call the number to pay a fine. THIS COMMUNICATION IS A BOGUS NOTICE.

No one affiliated with the Gwinnett Judicial Circuit Clerk of Superior Court’s office nor the Gwinnett County Sheriff's Office staffs send text or email messages to jurors of this nature. We would contact jurors via telephone but, when we do, the respective staff member will identify themselves. Our automatic telephonic messaging system provides notices to jurors concerning status of cases and appearances. If you are asked to call the office, the telephone number provided will be the main Gwinnett County switchboard number 770-822-8000.

Deeds and Land Records, Notary Applications, and Probate Court close at 4:30 PM. Courts and divisions may apply different hours and locations for activities and services. Please check their hours and locations accordingly.

If you have a summons or notice of hearing it should give you the location of the building where you should appear. If you are looking for a specific service then you may want to telephone to ask which building houses the court or department you are looking for at 770-822-8000.

A Parent Seminar is a four-hour educational seminar required of specific domestic actions involving a child or children under 18 years of age where the parties are involved in a divorce, separate maintenance, paternity, change of custody, visitation, legitimation, and any other domestic action, excluding contempt, and generally, domestic violence.

The program shall be successfully completed within 31 days of service of the original complaint upon the original defendant. Appropriate action, including but not limited to contempt, may be taken upon a party's failure to successfully complete the workshop. Parties do not have to attend the seminar with their spouses or ex-spouses. Children are not allowed in the workshop. Pre-registration is required.

You or your attorney will be required to file financial information on an approved "Child Support Worksheet" before the court can consider any calculation of child support. Both parties are required to file a worksheet.

This worksheet and instructions are available at the Superior Court Clerk's Office or may be found on-line in an electronic format at the Office of Child Support Services web site: https://services.georgia.gov/dhr/cspp/do/public/SupportCalc

This worksheet must be filed timely in accordance with the requirements of the statute and local court orders. You will not get a hearing without your information being accurately supplied on a worksheet filed with the clerk's office.
